This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

 

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms and Conditions for access or usage of www.silksbazaar.com website.

 

SilksBazaar.com (operated by Be Bold AI Technologies, a Bengaluru-based Start-up) provides high-quality personalised sarees. By accessing or using our website, you agree to be legally bound by these Terms and Conditions, along with our Privacy, Shipping, and Return policies. If you do not agree with any of these terms, you may not use or continue to use the site. You must be at least 18 years old and legally capable of contracting. SilksBazaar reserves the right to modify these Terms at any time without notice; the updated Terms will take effect when posted.

 

Your use of the Website and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Website including the applicable policies which are incorporated herein by way of reference. If You transact on the Website, You shall be subject to the policies that are applicable to the Website for such transaction. By mere use of the Website, You shall be contracting with Silksbazaar and these terms and conditions including the policies constitute Your binding obligations, with Silksbazaar.

 

The use of Silksbazaar and the services provided are subject to the rules and regulations, policies, notices, terms & conditions set forth in this Terms of Use. For the purposes of this Terms of Use, 'User' and wherever the context may require 'You' (or any variation thereof), shall mean any natural or legal person who has agreed to become a user of Silksbazaar by accessing or browsing the Website and/or has registered as a member of Silksbazaar by submitting identification information/ registration details using the computer system of Silksbazaar and accepting the electronic record of the Terms and Conditions, has obtained a unique username along and a secret alpha-numerical key (password) for using the Website.

 

This contract sets out your rights and responsibilities when you use the services provided by Silksbazaar (we’ll refer to our website and other services as our “Services”), so please read it carefully. By using any of our Services (even just browsing our website), you’re agreeing to the Terms. If you don’t agree with the Terms, you may not use our Services.

You also accept and agree to be bound by Silksbazaar Policies as amended from time to time.

 

Company Information: In compliance with Indian e-commerce regulations, we disclose our legal name and contact details. SilksBazaar.com is operated by Be Bold AI Technologies, headquartered in Bengaluru, India. We have appointed a Grievance Officer to address consumer complaints; their name and contact information are displayed on our site. All inquiries (product, order, or policy related) can be sent to our customer care email and phone. Any complaint will be acknowledged within 48 hours and resolved at earliest, as required by law.

 

Products and Orders: All products on our site are made-to-order sarees. We do not guarantee continued availability of any item until you complete checkout. Prices and product descriptions are subject to change without notice. Customized sarees can exhibit slight variations in color, texture, or weave; such variations are normal and are not considered defects. If an item is listed with a certain customization (e.g., fabric, print, stitching), that customization will be made to your specifications. Please review all product details carefully before ordering.

 

 

Order Acceptance: Placement of an order on our website constitutes an offer to purchase, subject to acceptance by SilksBazaar. We may refuse or cancel any order at our discretion (for example, if an item is out of stock or we suspect fraudulent activity). No order is binding on us until we email you an order confirmation or ship the product. We reserve the right to limit quantities or refuse service to any user.

 

Pricing and Payment: All prices on the site are quoted in INR (₹) and are final at the time of checkout. We accept payments only through our secure payment gateway (Cashfree) on the website. You must pay the full purchase price or partial price through online before order processing and other part of remain price can be paid at Cash on Delivery. By placing an order, you authorize SilksBazaar to process your payment via Cashfree; we do not store your payment credentials. You warrant that you are authorized to use the chosen payment method and that all payment information provided is correct. If payment fails or is suspected to be fraudulent, we may suspend or cancel your order.

 

Shipping: Domestic (within India) shipping is free on all orders. For international orders, shipping charges (including courier fees, insurance, and handling) are billed at cost to the customer and must be paid before dispatch. International shipments may be subject to import taxes, customs duties, or other fees levied by the destination country; these are the buyer’s responsibility. We ship via reputable courier services and provide tracking information once dispatched. SilksBazaar cannot guarantee delivery times, as actual transit depends on carrier and destination; we are not liable for delays caused by customs clearance, carrier issues, or events outside our control. The risk of loss transfers to you when the carrier picks up the package.

 

Returns and Replacements: Because all sarees are made to order for you, returns or exchanges for change of mind are not accepted. Customized or personalized sarees cannot be returned or replaced simply because you do not like them. The only exception is if a product is materially defective or damaged. If you believe an item is defective or incorrect, you must notify us by email within 48 hours of delivery, providing clear photos of the defect for evaluation. Upon confirming a manufacturing defect, we will arrange a replacement of the same item at no extra cost. We do not offer cash refunds for defective or damaged items; resolution is via replacement or a credit note. Please see our Return & Replacement Policybelow for more details.

 

Limitation of Liability: To the fullest extent permitted by law, SilksBazaar and Be Bold AI Technologies are not liable for any indirect, incidental, special or consequential damages arising out of or related to your use of the site or products, nor for delays or failures due to events beyond our control (including carrier delays, natural disasters, or regulatory actions). We do not guarantee uninterrupted or error-free service. Your sole remedies are those expressly stated in these terms.

 

Intellectual Property: All content on SilksBazaar.com (including text, graphics, images, logos, and software) is the property of SilksBazaar or its licensors and is protected by intellectual property laws. You may use the site content for personal, non-commercial purposes only. Any unauthorized use, reproduction, or distribution of our content is prohibited.

 

Privacy: Your use of SilksBazaar is also governed by our Privacy Policy, which explains how we collect and use your information. By using the site, you agree to its terms as well.

 

Prohibited Activities
You agree not to:

  • Use our platform for illegal purposes
  • Attempt to gain unauthorized access
  • Interfere with platform functionality
  • Post false, misleading, or harmful content

Subscription & Membership Terms

1. Membership Subscription Model

SilksBazaar.com offers an annual paid subscription membership (“Exclusive Membership”) that provides access to AI personalisation tools and other benefits as described on the website.

By subscribing to the membership, the customer agrees to the following terms:

  • The membership is valid for a period of one (1) year from the date of successful payment.
  • The subscription fee shall be as displayed on the website at the time of purchase.
  • Payment must be made in full through the approved payment gateway (Cashfree).
  • Access to membership features shall be activated only after successful payment confirmation.

2. Membership Benefits

Membership benefits may include, but are not limited to:

  • Access to AI Virtual Try-On
  • Access to AI Designer Stylist
  • Exclusive member discounts (including 10% discount on eligible products)
  • Early access to new collections
  • Member-only curated products
  • Priority support

SilksBazaar reserves the right to modify, enhance, or update membership features at its discretion without prior notice, provided that core benefits are not materially reduced during an active subscription period.

3. Subscription Charges & Billing

  • Subscription charges are clearly displayed on the website before checkout.
  • All subscription payments are processed securely via Cashfree.
  • The subscription fee is non-refundable once activated.
  • Prices are exclusive of applicable taxes unless otherwise stated.

4. Auto-Renewal (If Applicable)

If the membership is set to auto-renew:

  • The subscription shall automatically renew annually unless cancelled prior to the renewal date.
  • Renewal charges shall be billed using the original payment method on file.
  • Members may cancel auto-renewal at any time through their account settings before the renewal date.

The membership does not auto-renew. Customers must manually renew their subscription upon expiry.

5. Cancellation Policy

  • Members may cancel their subscription at any time.
  • Cancellation shall stop future renewals (if auto-renew is enabled).
  • No refund shall be provided for the remaining unused period of the membership.

6. Non-Transferability

Membership is:

  • Personal to the registered user.
  • Non-transferable.
  • Non-assignable.
  • Not shareable with third parties.

SilksBazaar reserves the right to suspend or terminate membership if misuse or sharing is detected.

7. Termination of Membership by SilksBazaar

SilksBazaar may suspend or terminate membership without refund if:

  • The member violates Terms & Conditions.
  • Fraudulent or abusive activity is detected.
  • The platform is misused in any manner.

8. AI Tool Disclaimer

Membership provides access to AI-powered personalisation tools. While the AI system is designed for high accuracy:

  • Colour recommendations are advisory in nature.
  • Final purchase decisions remain the responsibility of the customer.
  • SilksBazaar does not guarantee subjective satisfaction based on AI suggestions.

9. Limitation of Liability

SilksBazaar shall not be liable for:

  • Technical interruptions in AI services.
  • Temporary downtime.
  • Data loss due to force majeure events.
  • Indirect or consequential losses arising from membership usage.

10. Modification of Subscription Terms

SilksBazaar reserves the right to update subscription pricing, features, or structure for future subscribers. Existing active memberships will remain valid under the terms applicable at the time of purchase.

Legal and Governing Law: These Terms and your use of SilksBazaar.com are governed by the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.
